Terms and Conditions of Use
To use the Kilimanjaro Consulting Training Portal, you must agree to and accept the following Terms and Conditions of Use.

These TERMS AND CONDITIONS OF USE are effective as of the 1st of March, 2024.
Section A. General Terms and Conditions Policy |
- These TERMS AND CONDITIONS OF USE replaces all previous versions of these TERMS AND CONDITIONS OF USE.
- The TERMS AND CONDITIONS OF USE consists of the following Policies:

- Rights and Obligations Policy
- Maintenance Policy
- Courses and Recourses Policy
- Payments and Refunds Policy
- These POLICIES, collectively referred to as the TERMS AND CONDITIONS OF USE, apply to the KILIMANJARO CONSULTING TRAINING PORTAL (THE TRAINING PORTAL).
- Should a conflict arise between these TERMS AND CONDITIONS OF USE and any other agreement with Kilimanjaro Consulting that stipulates or alters a user's access to THE TRAINING PORTAL, courses, materials, or resources available on THE TRAINING PORTAL, these TERMS AND CONDITIONS OF USE will take precedence.
- For the purposes of clarity, the term CALENDAR DAY used in the TERMS AND CONDITIONS OF USE and anywhere on THE TRAINING PORTAL refers to the period 12:00am to 11:59pm on the same day.
- For the purposes of clarity, the term BUSINESS DAY used in the TERMS AND CONDITIONS OF USE and anywhere on THE TRAINING PORTAL refers to the period:
- 8:00am to 5:00pm New Zealand Standard/Daylight Savings Time
- 8:00am to 5:00pm Australian Eastern Standard/Daylight Savings Time
- 8:00am to 5:00pm Australian Western Standard Time
- For the purposes of clarity, the term ENROLMENT used in the TERMS AND CONDITIONS OF USE and anywhere on THE TRAINING PORTAL refers to any single instance where a user has access to a course, resource, and/or material. Unless access is extended in accordance with Clause 3 of the COURSES AND RESOURCES POLICY, each instance where a user is granted access to a course, resource and/or material will be deemed to be a new enrolment.
- For the purposes of clarity, the term ENROLMENT PERIOD used in the TERMS AND CONDITIONS OF USE and anywhere on THE TRAINING PORTAL refers to any specified length of time that a user has access to a course, resource, and/or material. An ENROLMENT PERIOD commences, for each ENROLMENT, from the date and time the user is granted access to a course, resource and/or material, until the user's access to the course, resource and/or material expires, subject to the COURSES AND RESOURCES POLICY and any additional TERMS AND CONDITIONS specified for the course, material and/or resource at the time of enrolment.
Section B. Rights and Obligations Policy |
- General
- This RIGHTS AND OBLIGATIONS POLICY replaces all previous versions of this RIGHTS AND OBLIGATIONS POLICY.
- Our Rights
- Kilimanjaro Consulting reserves the right to:
- Update and/or Amend the POLICIES within the TERMS AND CONDITIONS OF USE. Should such an update and/or amendment alter the meaning, intent and/or stipulations of the POLICIES within the TERMS AND CONDITIONS OF USE, users may be required to re-accept the associated POLICY or the TERMS AND CONDITIONS as a whole.
- Refuse access to THE TRAINING PORTAL if the TERMS AND CONDITIONS OF USE as a whole, or any part thereof, is not accepted.
- Revoke a user’s access to a particular course, material, or to THE TRAINING PORTAL.
- Restrict users’ access to certain courses, materials and resources.
- Deactivate a user's account if the user's account has been inactive for 2 years or longer. Users will be notified by email to advise them of the deactivation of their account.
- Kilimanjaro Consulting reserves the right to:
- User Accounts
- An active User Account is required to access the courses, materials and/or resources available on THE TRAINING PORTAL.
- All enrolments and/or access are specific to each User Account and not transferable to another User Account.
- Sharing of User Accounts (where the account is shared by multiple users) is not permitted.
- Only ONE account is permitted per user.
- The User Account must include the user's proper name and surname.
- Where multiple accounts have been created for the same user, only the first account will be permitted. All additional accounts for the same user will be removed, including all records associated with the additional accounts.
- The Forgot my password link on the Login screen can be used in the event that a user has forgotten their username or password.
- Your Rights and Responsibilities
- Users may request Kilimanjaro Consulting to:
- Revoke their access to a course.
- Revoke their access to THE TRAINING PORTAL.
- Update information on their User Profile.
- Reactivate their account if it has been made inactive after 2 years or longer of inactivity.
- Users agree that their User Account is for their own use only and not to share any details regarding their User Account, including login credentials, to any other user with the purpose of gaining access to THE TRAINING PORTAL and/or any of the courses, resources and materials available on THE TRAINING PORTAL.
- Users may request Kilimanjaro Consulting to:
- How your information may be used
- Kilimanjaro Consulting may use the contact information recorded in users’ profile to:
- Communicate new information regarding THE TRAINING PORTAL.
- Promote events, including, but not limited to, training courses.
- Provide information on products and services provided by Kilimanjaro Consulting, companies within the Enprise Group, and 3rd parties it is affiliated with.
- Promote products and services provided by Kilimanjaro Consulting, companies within the Enprise Group, and 3rd parties it is affiliated with.
- Kilimanjaro Consulting may use the contact information recorded in users’ profile to:
Section C. Maintenance Policy |
- General
- This MAINTENANCE POLICY replaces all previous versions of this MAINTENANCE POLICY.
- Kilimanjaro Consulting reserves the right to make THE TRAINING PORTAL unavailable at any time, for any length of period, to perform maintenance and platform upgrades.
- No financial compensation will be payable to users resulting from the loss of access during any period THE TRAINING PORTAL is unavailable.
- Unless otherwise explicitly stated elsewhere in this MAINTENANCE POLICY, for maintenance of any kind of FIVE CALENDAR DAYS OR LESS, users' access to courses, materials and/or other resources available on THE TRAINING PORTAL will not be extended.
- Users' access to courses, materials, and/or other resources available on THE TRAINING PORTAL will not be extended for maintenance of any kind if:
- Users have been granted access at no cost under a special agreement with Kilimanjaro Consulting.
- Users have been granted access as part of a Support Agreement with Kilimanjaro Consulting.
- Scheduled Maintenance
- For the purposes of clarity, SCHEDULED MAINTENANCE refers to any period of time where THE TRAINING PORTAL is scheduled, in advance, to be unavailable for a defined period of time.
- Notice of scheduled maintenance will be provided on the Home page of THE TRAINING PORTAL no less than THREE CALENDAR DAYS in advance.
- Kilimanjaro Consulting may, at its discretion, use alternative means, such as emails or newsletters, to notify users of scheduled maintenance.
- Subject to Clause 1.5 of this MAINTENANCE POLICY, where scheduled maintenance exceeds FIVE CALENDAR DAYS, users' access will be extended by:
- ONE CALENDAR DAY for each CALENDAR DAY that scheduled maintenance exceeds FIVE CALENDAR DAYS,
- up to a maximum of SEVEN CALENDAR DAYS.
- Unscheduled Maintenance
- For the purposes of clarity, UNSCHEDULED MAINTENANCE refers to any period of time where THE TRAINING PORTAL is unavailable, unexpectedly, as a result of any of the following:
- Unexpected downtime by Service Providers, such as Internet Service Providers, Domain Hosting Service Providers, etc., impacting the availability of THE TRAINING PORTAL.
- Unexpected issues with the platform, requiring THE TRAINING PORTAL to be unavailable while the issue is being investigated and resolved.
- Unexpected events, regardless of origin or cause, outside the direct or indirect control of Kilimanjaro Consulting.
- Users will not be notified in advance of any unscheduled maintenance.
- Where the period of unavailability due to unscheduled maintenance is less than TWO CALENDAR DAYS, users' access will not be extended.
- Subject to Clause 1.5 of this MAINTENANCE POLICY, were unscheduled maintenance exceeds TWO CALENDAR DAYS, users' access will be extended by:
- ONE CALENDAR DAY for each CALENDAR DAY that unscheduled maintenance exceeds TWO CALENDAR DAYS,
- up to a maximum of SEVEN CALENDAR DAYS.
- For the purposes of clarity, UNSCHEDULED MAINTENANCE refers to any period of time where THE TRAINING PORTAL is unavailable, unexpectedly, as a result of any of the following:
- Platform Upgrades
- For the purposes of clarity, PLATFORM UPGRADES refers to any period of time where THE TRAINING PORTAL is unavailable while the platform is undergoing an upgrade.
- Kilimanjaro Consulting will endeavour to minimise this period of unavailability, but cannot guarantee the length of time THE TRAINING PORTAL will be unavailable.
- Kilimanjaro Consulting may, at its discretion, extend this period of unavailability as required.
- Notice will be provided on the Home page of THE TRAINING PORTAL no less than SEVEN CALENDAR DAYS in advance.
- Kilimanjaro Consulting may, at its discretion, use alternative means, such as emails or newsletters, to notify users of platform upgrades.
- Subject to Clause 1.5 of this MAINTENANCE POLICY, where the length of time THE TRAINING PORTAL is unavailable due to a Platform Upgrade exceeds FIVE CALENDAR DAYS, users' access will be extended by:
- ONE CALENDAR DAY for each CALENDAR DAY exceeding FIVE CALENDAR DAYS of unavailability,
- up to a maximum of FORTEEN CALENDAR DAYS.
Section D. Courses and Resources Policy |
- General
- This COURSE AND RESOURCES POLICY replaces all previous versions of this COURSES AND RESOURCES POLICY.
- This COURSES AND RESOURCES POLICY applies to all courses, materials and resources available on THE TRAINING PORTAL.
- Every effort has been made to ensure the accuracy, relevance and completeness of courses and materials available on THE TRAINING PORTAL but excludes (to the extend allowed by legislation) any warranties regarding it.
- Neither Kilimanjaro Consulting, its staff, nor its agents, shall be held liable for any loss, cost or damage (however incurred, including negligence) arising out of errors or omissions in courses and materials, especially if such courses and materials contain information sourced from third parties, such as the Australian Tax Office or the New Zealand Inland Revenue Department.
- Courses and materials may include content developed by MYOB Technology Pty Ltd and has been reproduced with permission.
- Courses, materials, and resources, including but not limited to audio, video, text-based, and downloadable content, may not be copied, altered, edited or distributed, including to those within your organisation or related companies, by any means, without the prior written consent of Kilimanjaro Consulting.
- By enrolling in a course on THE TRAINING PORTAL, the user agrees to commit the time required to complete the course within the allotted timeframe.
- Course Restrictions
- Kilimanjaro Consulting reserves the right to:
- Restrictions access to, and the availability of, courses and all related materials (including audio, video, text-based, and downloadable content), materials, and resources available on THE TRAINING PORTAL,
- for a limited time period, or
- to a limited number of CALENDAR DAYS from date of enrolment/purchase, or
- for a limited time period as well as a limited number of CALENDAR DAYS from date of enrolment/payment, or
- at its sole discretion.
- Alter the restrictions to, and the availability of, courses, materials, and resources, at any time without prior notice.
- Restrictions access to, and the availability of, courses and all related materials (including audio, video, text-based, and downloadable content), materials, and resources available on THE TRAINING PORTAL,
- Kilimanjaro Consulting reserves the right to:
- Course Extensions
- In the event that the course cannot be completed within the allotted timeframe, the user may, in writing only, via email, request an extension to their access to the course. This request must be:
- sent to training@kilimanjaro-consulting.com, and
- received no later than FIVE BUSINESS DAYS after access to the course and/or material has expired.
- Requests for an extension will not be accepted if:
- the email requesting an extension was not sent to training@kilimanjaro-consulting.com, or
- the email requesting an extension was received more than FIVE BUSINESS DAYS after access to the course and/or material has expired.
- Users may request a MAXIMUM of TWO extensions per enrolment.
- Kilimanjaro Consulting may grant an extension at its sole discretion.
- Kilimanjaro Consulting reserves the right to determine the number of CALENDAR DAYS for each extension, with
- the minimum extension being no less than SEVEN CALENDAR DAYS (ONE WEEK) and
- the maximum extension being no more than FIFTY-SIX CALENDAR DAYS (EIGHT WEEKS).
- In the event that the maximum number of extensions have already been granted for the course and/or material:
- No further extensions will be granted.
- The user must re-enrol in the course and/or material, with the applicable fees payable again, in full, forfeiting all previous completion progress.
- In the event that the course cannot be completed within the allotted timeframe, the user may, in writing only, via email, request an extension to their access to the course. This request must be:
- Course Updates
- Kilimanjaro Consulting reserves the right to update, remove or replace courses and all related materials (including audio, video, text-based, and downloadable content), materials, and resources available on THE TRAINING PORTAL at its discretion, at any time, without notice.
- Where a user is currently enrolled in, or has access to, an updated course, material or resource:
- The user's current enrolment in, or access to, the course, material or resource will not be altered.
- The user may be required to complete the updated course components again.
- Updated material or resource must be accessed or downloaded (if available) again to obtain the updated content.
- Where the user's enrolment in an updated course, or their access to updated material or a resource, has expired prior to the update:
- The user will not be granted access to the updated course, material, or resource.
- Should the user wish to access the updated course, material, or resource, the user must enrol in the updated course, or purchase access to the updated material or resource, with the applicable course fees payable in full.
- Where the user currently has access to material, or a resource that has been replaced:
- The user will be granted access to the replacement material or resource at no additional cost.
- The replaced material or resource will no longer be accessible.
- Where the user is currently enrolled in a course that is replaced by a new course:
- The user will be notified (via the Course) that the course has been replaced and will no longer be available after a specified date.
- The user's enrolment will be transferred to the new course at no additional cost.
- Completion progress from the replaced course is not transferable to the new course. Any components completed in the replaced course must be completed again in the replacement course.
- After the specified date, the replaced course will no longer be available and the user will no longer be able to access the replaced course.
Section E. Payments and Refunds Policy |
- General
- This PAYMENTS AND REFUNDS POLICY replaces all previous versions of this PAYMENTS AND REFUNDS POLICY .
- This PAYMENTS AND REFUNDS POLICY applies to all courses, materials and resources available on THE TRAINING PORTAL.
- Kilimanjaro Consulting reserves the right to alter pricing without prior notice.
- Course Fees
- All payable fees must be paid in full by Credit Card at the time of enrolment or purchase, and cannot be charged to your account with Kilimanjaro Consulting.
- All payments will incur a Credit Card Processing fee.
- This Processing Fee is charged directly by the Payment Gateway (Stripe).
- Kilimanjaro Consulting has no influence over this Processing Fee or the rate at which this Processing Fee is charged.
- For clients based in Australia, unless otherwise stated, prices listed on THE TRAINING PORTAL are inclusive of:
- 10% GST, and
- a Credit Card Processing fee of 1.75% for purchases prior to April 1st, 2024, or
- a Credit Card Processing fee of 1.70% for purchases after March 31st, 2024.
- 10% GST, and
- For clients based in New Zealand, unless otherwise stated, prices listed on THE TRAINING PORTAL are inclusive of:
- 15% GST, and
- a Credit Card Processing Fee of 2.7%.
- Invoicing
- A Tax Invoice for the fees (excluding the Credit Card Processing Fee) will be sent within FOURTEEN BUSINESS DAYS.
- For clients of Kilimanjaro Consulting, the Tax Invoice will be sent to the nominated email address on record.
- For non-Kilimanjaro Consulting clients, our Accounts Department will contact you to obtain the relevant details for providing the Tax Invoice.
- This invoice is for your records only and no additional payment will be required.
- A Tax Invoice for the fees (excluding the Credit Card Processing Fee) will be sent within FOURTEEN BUSINESS DAYS.
- Refunds
- If a purchase is made in error, a refund may be requested.
- To be eligible for a refund, the course content (including but not limited to audio, video, text-based, and downloadable content), material, or resource must not have been accessed. Course content (including but not limited to audio, video, text-based, and downloadable content), material, or resource that have been accessed since the purchase was made are ineligible for a refund.
- To request a refund:
- An email requesting a refund must be sent to training@kilimanjaro-consulting.com.
- The request for a refund must be received before :
- 2:00pm Australian Eastern Standard Time/1:00pm Australian Eastern Daylight Savings Time
- 4:00pm New Zealand Standard Time/3:00pm New Zealand Daylight Savings Time
- 11:00am Australian Western Standard Time
- Once the request has been reviewed and the eligibility for a refund has been confirmed by Kilimanjaro Consulting, a refund of the full amount, inclusive of GST and the Credit Card Process Fee, will be processed within THREE TO FIVE BUSINESS DAYS.
- Refunds will not be issued if:
- The course(s), material(s) and/or resource is ineligible for a refund, or
- the request for a refund is not sent to training@kilimanjaro-consulting.com, or
- the request for a refund is received after:
- 2:00pm Australian Eastern Standard Time/1:00pm Australian Eastern Daylight Savings Time
- 4:00pm New Zealand Standard Time/3:00pm New Zealand Daylight Savings Time
- 11:00am Australian Western Standard Time
